Welcome to Spotsers! These Terms of Service ("Terms") govern your use of the Spotsers Experts Ltd. website, mobile application, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, booking a service, or otherwise accessing or using any part of the Service, you signify your acceptance of these Terms and any future modifications. We reserve the right to modify these Terms at any time. We will notify you of significant changes through our Service or via email. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

3. Account Registration

To access certain features of the Service, you may be required to register for an account. 4. Service Booking and Payments

4.1 Booking Services

Spotsers acts as a platform to connect users with independent third-party service professionals ("Professionals"). While we vet our Professionals, Spotsers does not directly provide the services. When you book a service through our platform, you are entering into a direct agreement with the Professional for the provision of that service.

4.2 Pricing and Payment

The prices for services are displayed on the Service and are subject to change. You agree to pay all fees and charges incurred in connection with your bookings. All payments are processed securely through third-party payment gateways. You agree to provide valid payment information and authorize us to charge your selected payment method for all services booked.

4.3 Cancellations and Refunds

Please refer to our separate Cancellation & Refund Policy for details on canceling services and eligibility for refunds.

5. User Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by any third party. Prohibited conduct includes, but is not limited to:

  • Engaging in any illegal activity or promoting any illegal acts.
  • Harassing, abusing, or harming another person or group.
  • Impersonating any person or entity.
  • Uploading or transmitting any viruses or malicious code.
  • Attempting to gain unauthorized access to our Service, user accounts, or computer systems.
  • Using the Service for any commercial purpose not expressly approved by Spotsers.

6. Intellectual Property

All content on the Service, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Spotsers Experts Ltd. or its content suppliers and protected by international copyright laws. The compilation of all content on this Service is the exclusive property of Spotsers and protected by international copyright laws.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SPOTSERSS EXPERTS LTD. MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THE SERVICE. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, SPOTSERSS EXPERTS LTD. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL SPOTSERSS EXPERTS LTD., NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Guwahati, Assam, India.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
